Ban on Kaspersky Lab Software in Federal Projects

Recently, Federal Contracts have been including a new FAR Clause 52.204-23 Prohibition on Contracting for Hardware, Software, and Services Developed or Provided by Kaspersky Lab and Other Covered Entities (Jul 2018), which prohibits the use of hardware, software, or service from Kaspersky Lab and Other Covered Entities for federal projects.  It requires the University to confirm that the awarded contract project’s personnel (including subawards):

  • Will not use in the development of data or deliverables, or provide for Government use, any hardware, software, or service that:
    • Is developed or provided by Kaspersky Labs (or other covered entity)
    • Includes any hardware, software, or service developed or provided in whole or in part by Kaspersky Labs (or other covered entity); or
    • Contains components using any hardware or software developed in whole or in part by Kaspersky Labs (or other covered entity).

In the event that the project’s personnel does use any of the aforementioned items or provide them to the Government, the University will be required to report that usage to the Government as specified in Section C of the clause.
